課程概述 |
在2017年行政院原住民族委員會公布的「原住民族土地劃設辦法」裡，對於私有地的排除進而引發了新一波的原住民土地運動。運動的訴求除了國家必須肯認原住民在台灣歷史上的特殊位置與承受的不正義，更觸及國家與原住民關係的檢討及重新建構，包括「部落諮商」、「部落共管」等概念的提出，其運動的理想目標是朝向國與國的對等夥伴關係。
這樣的現象不只發生在土地議題，也發生於法律範疇，包括近年許多新的 原住民相關立法或修法，例如：原住民傳統智慧創作保護條例、部落公法人組織設置辦法、與狩獵採集相關之保育法修法、諮商取得原住民族部落同意參與辦法、原住民專庭等，以及指標性司法事件，例如：司馬庫斯櫸木案、最高法院獵槍除罪判決、布農獵人王光祿非常上訴案等，甚至是文化資產相關的爭議事件，如：太巴塱國寶木雕、古樓排灣族五年祭，以及原住民傳統智慧財產權爭議案件。
隨著國際原住民權利運動的發展、台灣民主化的進程、以及新一代行動者 的論述與實踐，原住民與國家的關係無論在文化、政治、社會想像層次，或實際執行面都邁入新局，兩者間的關係逐漸朝有別於過往結構的新型態發展，國家由上而下制定政策與分層執行的統治模式弱化，轉向更多重行動者（包含公、私部門、非政府組織、運動者、學者、部落居民等）之間的協商。此種模式的改變呼應了社會科學界從統治轉向「治理」(governance)的研究典範。

課程目標 |
本課程主要探討當代原住民與國家之間的「治理」樣貌，包括空間治理、經濟治理、都市治理、文化治理，並特別著墨於幾個新興概念──如傳統領域、部落自治、山林共管、兩地社會、金融資本、文化資產、傳統智慧財產權等──如何在過程中為各方所共同形塑與挪用。
無論是「治理」模式或上述議題的發展，都涉及全球到地方跨尺度、層級的連結與辯證，因此課程中將由七位長期從事南島研究的學者輪流授課，透過比較南島研究的視野，從個別部落、周邊區域、地方政府、中央機構、甚至跨國比較等不同尺度進行分析。

這是一門以專題演講為主的課程，修課同學仍需要閱讀當週的材料並針對當周讀物做討論摘要報告。前兩堂將以該週授課老師演講為主，第三堂則需要同學們參與課堂討論。
